Elisa is an AI-powered email assistant that assists users, among other tasks, with the following:

• Categorizing and tagging messages

• Creating response drafts

• Reports and summaries

• Configurable automation of email workflows

The Service is provided as Software as a Service (SaaS).

4. Registration and Account

4.1 Prerequisites

Using certain features requires the creation of a user account.

The user commits to providing accurate and complete information during registration.

4.2 Access Data

• Access data must be treated as confidential

• the user is responsible for all activities under their account

• in case of suspicion of misuse, the provider must be informed immediately

5. Connection of Email Accounts

To use the email assistant, email accounts can be connected, e.g., via:

• IMAP

• OAuth (e.g., Google, Microsoft)

The user assures that they are entitled to connect the email accounts.

Access data and tokens will be stored encrypted and protected against unauthorized access.

6. Use of Artificial Intelligence

Elisa uses AI-based systems to process email content.

Important notes:

• AI-generated content does not constitute binding legal or professional advice

• Response drafts are solely for suggestion purposes

• the user is responsible for reviewing and sending emails

The provider assumes no liability for the content accuracy, completeness, or appropriateness of AI-generated results.

7. Responsibilities of Users

Users agree to particularly:

• not misuse the Service

• not process unlawful, offensive, or harmful content

• not circumvent security mechanisms

• comply with applicable laws and third-party rights

Usage of the Service for spam, phishing, or other abusive purposes is prohibited.

8. Availability and Changes

The provider strives to ensure high availability but cannot guarantee it.

The provider reserves the right to:

• change, further develop, or discontinue functions

• temporarily maintain or interrupt the Service

9. Liability

9.1 Disclaimer of Liability

The Service is provided "as is".

The provider is not liable for:

• data loss resulting from improper use

• damages from AI-generated content

• failures or disturbances beyond their control

9.2 Limitation of Liability

Liability is limited to intent and gross negligence as permitted by law.

Mandatory legal liability claims remain unaffected.

10. Fees and Payment Processing

If paid services are offered:

• the published prices apply

• billing occurs through the payment service provider Stripe

• subscriptions renew automatically unless canceled

11. Termination

Users can terminate their account at any time.

The provider reserves the right to suspend or delete accounts in the event of breaches of these Terms of Use.

12. Data Protection

The processing of personal data is carried out in accordance with the Privacy Policy, available at meet-elisa.ai.

13. Changes to the Terms of Use

The provider reserves the right to adjust these Terms of Use.

Changes will be communicated in a suitable manner.
By continuing to use the Service, the modified terms are considered accepted.

14. Applicable Law and Jurisdiction

Swiss law applies, excluding conflict of laws.

The place of jurisdiction is – to the extent permitted by law – the registered office of MADLAB GmbH.
